Credits & Packages Terms

Contracting party, scope & acceptance

These Credits & Packages Terms (“Credits Terms”) are between you and Peekamoji ApS, Viborgvej 58, 9600 Aars, Denmark (CVR: 45351459), and apply whenever you purchase, receive, hold or use Peekamoji Credits, Coins, Packages or other in-app virtual items.

These Credits Terms supplement our Terms of Use. By completing a purchase or using Credits after these Credits Terms are presented to you, you agree to them. If mandatory law gives you rights that cannot be waived, those rights always take priority.

Marketplace purchases of physical goods are governed by the separate Marketplace Terms. Creator earnings, withdrawals and payouts are governed by the separate Creator Earnings & Payout Terms.

Definitions

For these Credits Terms:

• “Credits” means purchased or granted virtual units used within Peekamoji. The app may display a particular virtual balance using names such as Coins or another product name.
• “Package” means a one-time bundle of Credits or eligible digital items offered for a stated price.
• “Promotional Credits” means free, bonus, reward, promotional or otherwise non-purchased Credits.
• “Purchase Channel” means Apple In-App Purchase, Google Play Billing or another payment method Peekamoji is lawfully permitted to offer in your region and app version.
• “Creator Earnings” means a separate creator-side balance or entitlement that may arise from eligible creator-support activity. Creator Earnings are not the same balance as a purchaser’s Credits.

Eligibility & authority to purchase

You may purchase Credits only if you are legally permitted to make the purchase and use the relevant Purchase Channel. If you are below the age of legal majority in your country, you must have any parent, guardian or other authorization required by law or by the Purchase Channel.

You are responsible for purchases made through your account or device to the extent permitted by law. Platform family controls, device purchase controls and payment-provider authentication may also apply.

Nature of Credits

Credits are designed as closed-loop in-app virtual items for use only within eligible Peekamoji features. Peekamoji does not offer Credits as legal tender, a bank deposit, cryptocurrency, investment product or general-purpose payment instrument.

Purchasers cannot withdraw Credits for cash, transfer them outside Peekamoji or demand redemption at their original purchase price. Nothing in these Credits Terms overrides any legal classification or consumer protection that mandatory law requires.

A purchaser’s Credit balance is separate from any Creator Earnings balance. If a user spends Credits to support a creator, the Credits are consumed under the user-side system and any creator-side earning is calculated separately under the Creator Earnings & Payout Terms.

Packages & one-time purchases

Unless a purchase screen expressly states otherwise, a Package is a one-time purchase, not an automatically renewing subscription. Before purchase, the official purchase flow will show the Package, quantity, price and any included bonus or benefit.

If Peekamoji later offers subscriptions or recurring purchases, the recurring nature, billing period, cancellation rules and any separate terms will be presented before purchase.

Purchase channels & billing rules

Digital Credits and Packages purchased inside a Peekamoji app must use the billing method required or permitted for the relevant platform, region and app version. This may include Apple In-App Purchase, Google Play Billing or an eligible alternative billing method where platform rules and law permit it.

The Purchase Channel may act as payment processor or merchant of record and may apply its own billing, authentication, receipt, refund and dispute rules. Those rules apply in addition to these Credits Terms where relevant.

Peekamoji will not intentionally direct an in-app purchase to a payment method prohibited by the applicable app-store rules.

Prices, taxes, currency & platform differences

The final price shown in the official purchase confirmation controls the transaction. Prices may vary by country, currency, Purchase Channel, tax treatment, store pricing tier, exchange rate or lawful promotional offer.

Applicable VAT, sales tax or similar charges may be included in or added to the displayed price depending on the Purchase Channel and local law. Payment providers, banks or currency-conversion services may impose additional charges outside Peekamoji’s control.

Prices and Package quantities for future purchases may change. A change does not alter the number of Credits already validly credited to your account, except for permitted corrections, refunds, reversals or fraud adjustments.

Purchase confirmation, delivery & receipts

After a successful purchase, the purchased Credits should be credited to the Peekamoji account associated with the transaction without undue delay. A receipt or purchase confirmation may be issued by Apple, Google, Peekamoji or another payment provider.

If payment succeeds but the Credits do not appear, do not repeatedly repurchase the same Package. Use any available restore/sync function and contact support with the transaction receipt or order identifier.

Where a purchase is technically restorable under the applicable platform rules, Peekamoji will provide or support an appropriate restore mechanism. Consumable Credit balances may instead be restored or synchronized through Peekamoji’s account/server records.

Using Credits

Credits may be used only for eligible digital features shown inside Peekamoji. The number of Credits required for a feature or virtual item will be shown before you confirm the use where reasonably practicable.

Using Credits generally consumes the stated amount immediately. Once consumed, Credits do not automatically return merely because you later change your mind, stop using the feature, do not receive a response from another user or creator, or dislike the outcome, subject always to mandatory consumer rights and genuine service failures.

Peekamoji may change the Credit cost of future features or virtual items. We will not retroactively reduce your valid Credit balance simply because future pricing changes.

Creator support, tips & gifts

Where creator-support or tipping is available, you may be able to spend Credits to voluntarily support an eligible creator or digital content provider. Unless the relevant feature expressly states otherwise, a tip is not a purchase of physical goods and does not guarantee a response, follow, message, service, content deliverable or other benefit from the creator.

The amount of Credits a user spends is not a promise that the creator receives the same nominal monetary value. Creator Earnings are calculated separately and may be affected by applicable platform commissions, taxes, payment costs, refunds, chargebacks, currency conversion, payout costs and the creator revenue-share rules disclosed in the Creator Earnings & Payout Terms.

If gifting of eligible in-app items is offered, gifting must occur through the official feature. Where app-store rules require it, any refund of a gifted item is made only to the original purchaser and the gift cannot be exchanged for cash.

No resale, transfer or off-platform trading

Unless an official Peekamoji feature expressly allows it, Credits may not be sold, resold, exchanged, transferred between accounts, traded for money or other value, pledged, brokered or marketed on third-party services.

Any permitted gifting or transfer feature may have additional limits, fraud controls and feature-specific rules. Unauthorized Credit trading may result in cancellation of affected transactions, balance correction or account restrictions, subject to applicable law.

Purchased Credits do not expire

Purchased Credits do not expire solely because time passes. They remain associated with your eligible Peekamoji account while the Credit program and account remain available, subject to these Credits Terms, lawful corrections, refunds, reversals and account enforcement.

Promotional Credits may have an expiry date, usage limit or eligibility condition, but only where that condition is clearly disclosed when the Promotional Credits are granted or in the applicable promotion rules. Promotional Credits are not treated as purchased Credits merely because they appear in the same interface.

Randomized virtual items

If Peekamoji ever allows Credits or money to be used for a mechanism that awards a randomized virtual item or reward, the applicable odds or probability information will be disclosed before purchase where required by platform policy or law.

Unless and until such a feature is expressly offered, these Credits Terms do not create any right to randomized rewards, loot boxes, gambling or cash-prize functionality.

Refunds & cancellations

Refund rights depend on mandatory law, the reason for the request and the Purchase Channel used. Where Apple, Google or another payment provider controls the refund process, you may need to request the refund through that provider. Peekamoji may assist with transaction information where appropriate.

Nothing in these Credits Terms limits any refund, price reduction, cancellation, conformity or other remedy that you are entitled to under mandatory consumer law.

Except where law or the Purchase Channel gives you a right to a refund, successfully delivered and consumed Credits are generally non-refundable. Peekamoji may also issue discretionary refunds or account credits without creating an obligation to do so in future cases.

EU/EEA withdrawal rights for digital supply

If you are an EU/EEA consumer and a statutory right of withdrawal applies to a purchase, that right remains available unless a valid legal exception applies.

Where applicable law permits immediate supply of digital content or a digital service during the withdrawal period only after your prior express consent and your acknowledgement that you lose the right of withdrawal once performance begins, Peekamoji or the relevant Purchase Channel must obtain the required consent/acknowledgement and provide any legally required confirmation before relying on that exception.

If the legal requirements for loss of the withdrawal right are not satisfied, nothing in these Credits Terms removes the statutory right.

Non-delivery, defects & digital-content remedies

If paid Credits are not supplied, are materially incorrect, or a paid digital feature does not conform to what was promised, contact support and/or the Purchase Channel. Where applicable law provides rights to bring digital content or services into conformity, receive a price reduction, terminate the contract or obtain a refund, those rights remain unaffected.

Peekamoji may first attempt a reasonable technical correction, re-credit, synchronization or restoration where that is an appropriate remedy and does not delay a statutory remedy unlawfully.

Chargebacks, reversals & payment disputes

If a purchase is refunded, reversed, charged back, cancelled by the Purchase Channel or found to be unauthorized or invalid, Peekamoji may remove the corresponding unused Credits or reverse benefits obtained from that transaction to the extent lawful.

If Credits from a reversed transaction have already been spent, the account may temporarily show a negative or adjusted internal Credit balance, or access to further Credit spending may be restricted while the transaction is resolved. An internal negative Credit balance does not by itself create a cash debt owed to Peekamoji unless a separate legal basis makes an amount payable.

Do not use chargebacks or payment disputes fraudulently. A genuine payment dispute will not be treated as misconduct merely because you exercise a lawful consumer or payment right.

Balance corrections & technical errors

Peekamoji may correct obvious technical, accounting or duplication errors, including Credits credited twice, Credits granted without a completed payment, or incorrect deductions. We may also restore Credits that were wrongly deducted because of a verified technical failure.

We will not knowingly remove validly purchased Credits without a legitimate reason such as a refund, reversal, fraud finding, account correction, legal requirement or other basis permitted by these Credits Terms and applicable law.

Account security & unauthorized purchases

Keep your Peekamoji account, device and payment credentials secure. If you believe a purchase or Credit use was unauthorized, contact the relevant Purchase Channel and Peekamoji support promptly.

Responsibility for unauthorized purchases is determined by applicable law, the Purchase Channel’s rules and the facts of the case. Nothing in these Credits Terms makes you responsible where mandatory law says you are not.

Account deletion, suspension & termination

Deleting your Peekamoji account may permanently remove access to any remaining Credit balance after the deletion is completed. You should use any remaining Credits before requesting permanent deletion if you wish to use them, subject to any statutory refund or withdrawal rights.

If an account is suspended or restricted for safety, fraud, legal or policy reasons, access to Credits may also be restricted. The treatment of remaining purchased Credits will be subject to applicable law, the reason for the restriction, Purchase Channel rules and any available remedy.

Account deletion does not erase transaction records that Peekamoji or a payment provider must lawfully retain for tax, fraud prevention, accounting, dispute or regulatory purposes.

Program changes, discontinuation & service availability

Peekamoji may modify, replace or discontinue Credit features for legal, technical, safety or business reasons. Where a material change affects an existing purchased balance, we will handle that balance in accordance with mandatory law and, where reasonably practicable, provide notice or a reasonable opportunity to use the Credits before discontinuation.

If Peekamoji permanently discontinues a paid Credit program and you cannot reasonably use a valid purchased balance, any refund, substitute benefit or other remedy will be determined by applicable law and the relevant Purchase Channel.

Temporary outages, maintenance or technical failures do not by themselves cancel a purchase, but statutory remedies for prolonged or material non-performance remain unaffected.

Fraud, abuse & prohibited conduct

You must not manipulate purchases, exploit pricing or technical errors, create artificial transactions, use stolen payment instruments, launder value through Credits, sell accounts for their Credit balance, automate unauthorized purchases, abuse refund systems, or use Credits in connection with unlawful activity.

We may investigate suspicious activity and, where reasonably necessary, delay Credit use, reverse invalid transactions, restrict features, require verification or take account action. Any action will remain subject to applicable law and our Terms of Use.

Privacy & transaction data

Our Privacy Policy explains how Peekamoji processes transaction records, billing-related information, creator-support records and payout-related information where relevant.

Full payment-card details may be handled directly by Apple, Google or another payment provider rather than Peekamoji. Those providers process data under their own terms and privacy policies in addition to any data Peekamoji receives for transaction verification, accounting, fraud prevention and support.

Changes to these Credits Terms

We may update these Credits Terms to reflect changes to the product, law, payment systems, app-store requirements, security needs or business operations. The “Last Updated” date identifies the current published version.

Material changes will be communicated where required by law. We will not use a later version of these Credits Terms to retroactively remove non-waivable consumer rights or unlawfully alter a completed purchase.

Governing law & disputes

These Credits Terms are governed by Danish law, subject to mandatory consumer and other protections that apply in your country of residence.

Nothing in these Credits Terms limits any right you may have to bring a dispute before a competent court, consumer authority or other legally available dispute-resolution body.

Disputes relating to payment processing or refunds may also be subject to the procedures of Apple, Google, your bank, card issuer or another applicable Purchase Channel.
