Who you’re contracting with

These Terms are between you and Peekamoji ApS, Viborgvej 58, 9600 Aars, Denmark (CVR: 45351459). References to “Peekamoji”, “we”, “us” or “our” refer to Peekamoji ApS.

Services covered by these Terms

These Terms govern your access to and use of Peekamoji’s applications, websites, software and related services (“Platform”), including profiles, feeds, posts, short videos (“Peeks”), messaging, groups, reactions, live features, calls, discovery, personalization, creator tools, wallet functionality, Marketplace features and other functionality we make available.

Some features may be introduced, changed, limited, tested or unavailable depending on country, device, account, app version or rollout stage. The availability of a feature does not guarantee that it will remain available permanently.

Nothing in these documents removes rights that cannot lawfully be excluded or limited.

Age, eligibility & authority

You must be at least 16 years old to use Peekamoji. Some jurisdictions may require a higher minimum age, parental or guardian consent, or additional protections for minors.

Payment, monetization, creator, Marketplace, live or other features may have additional age, identity, legal-capacity, verification or eligibility requirements. Where a purchase requires authorization from a parent, guardian, account holder or payment provider, you must have that authorization before purchasing.

If we reasonably believe an account does not meet an applicable age or eligibility requirement, we may restrict the relevant feature or account, subject to applicable law.

Accounts, usernames & security

• Provide accurate information where required and keep material account details reasonably up to date.
• Do not impersonate another person, organization or brand in a deceptive or misleading manner.
• Keep login credentials and verification codes secure and notify us if you reasonably suspect unauthorized access.
• Do not sell, rent or transfer an account where doing so would undermine safety, security, verification, payments or platform integrity.
• We may rename, reclaim or restrict usernames where reasonably necessary to address impersonation, rights violations, abuse, inactivity or platform integrity.

Your responsibility for unauthorized activity or purchases is always subject to applicable law and the rules of the relevant payment or app-store provider.

Conduct & prohibited activity

You must comply with our Community Guidelines and applicable law. Prohibited activity includes harassment, hate, threats, child sexual exploitation, illegal activity, fraud, scams, serious privacy violations, intellectual-property infringement, malicious software, unauthorized access, deceptive impersonation and other conduct prohibited by our policies.

You must not artificially manipulate reactions, followers, views, rankings, recommendation systems, Creator Scores, VibeScores, engagement, transactions, creator earnings or other platform metrics through bots, fake accounts, coordinated abuse, self-dealing or other deceptive methods.

You must not misuse reporting, payment, refund, chargeback, tipping, Credits, payout or Marketplace systems. Genuine use of a lawful complaint, refund, appeal or consumer right is not misuse merely because it results in a dispute with Peekamoji.

Content you upload

You keep ownership of rights you hold in content you upload. To operate and improve Peekamoji, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, distribute, adapt, format, transmit and technically process your content as reasonably necessary to provide, secure, moderate, promote and improve the Platform, subject to applicable law and your privacy settings.

You represent that you have the rights and permissions required to upload and share the content and that your use of the Platform does not violate the rights of others.

When you delete content, we will stop using it as active Platform content within a reasonable period, subject to technical backups, content already shared or reproduced by other users, legal retention requirements, safety records and other lawful reasons for limited retention.

Location sharing is optional. When uploading content, you may choose to allow Peekamoji to access your device’s location and attach location information to your content. You can decline location access and upload content without sharing your location. Location information attached to published content may be visible to other users depending on your content’s privacy settings.

Peekamoji intellectual property

The Platform, including Peekamoji software, interfaces, visual design, branding, logos, trademarks and other materials supplied by Peekamoji, is owned by or licensed to Peekamoji and is protected by applicable intellectual-property laws.

Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable and revocable right to access and use the Platform for its intended purposes. This does not transfer ownership of Peekamoji intellectual property to you.

You must not copy, sell, license, reverse engineer, circumvent security, scrape at scale, or create unauthorized derivative products from the Platform except where applicable law expressly permits the activity notwithstanding these Terms.

Third-party services & app stores

Peekamoji may interact with services operated by third parties, including Apple, Google, login providers, payment providers, cloud services, external websites and sharing integrations. Their own terms and privacy policies may apply to your use of those services.

Where you download Peekamoji through an app store, the applicable app-store terms and platform rules also apply. If a third-party rule conflicts with these Terms in a matter controlled by that third party, the third-party rule may govern that specific relationship, subject to applicable law.

Peekamoji is not responsible for the independent operation of third-party services except to the extent applicable law provides otherwise.

Commercial, sponsored & creator activity

If you publish advertising, sponsored, gifted, affiliate or branded content, you are responsible for complying with applicable disclosure, advertising and consumer-protection laws and any feature-specific Peekamoji rules.

If creator-support, tipping, virtual items, subscriptions, monetization or payout features are offered, additional eligibility, pricing, fee, verification, tax and payout rules may apply.

Creator earnings, withdrawals and payouts are governed by our Creator Earnings & Payout Terms. Participation in a creator or monetization feature does not by itself create employment, agency, partnership or joint-venture status between you and Peekamoji.

Purchases, Credits, virtual items & refunds

If Peekamoji offers digital purchases, Credits, Coins, Packages, virtual items or other paid digital features, our Credits & Packages Terms apply together with the billing rules of Apple, Google or another applicable purchase channel.

Purchased Credits and other user-side virtual items are not creator earnings and do not represent a bank deposit, stored cash account or general-purpose payment instrument. They have no cash value or redemption right except where a specific lawful feature expressly provides otherwise.

Refund, withdrawal, cancellation, delivery and consumer rights depend on applicable law, the relevant purchase channel and the applicable feature-specific terms. Nothing in these Terms reduces mandatory consumer rights.

Do not fraudulently acquire, manipulate, resell, trade off-platform or exploit virtual items, purchases, refunds, chargebacks or payment systems.

Marketplace features

If Peekamoji makes Marketplace features available, the separate Marketplace Terms apply. Marketplace availability may vary by country, account, app version or rollout stage.

Unless expressly stated otherwise for a specific transaction, Peekamoji provides the technical platform and is not the buyer, seller or manufacturer of user-listed physical goods.

Privacy, data & retention

Our Privacy Policy explains how we collect, use, disclose and retain personal data. Our Cookie Policy explains our use of cookies and similar technologies where relevant.

You can request deletion of your account or personal data using our in-app controls where available or the Delete Data and Delete Account pages.

Limited information may be retained where necessary for legal obligations, accounting, tax, fraud prevention, security, payment disputes, enforcement, safety investigations, backups or the establishment, exercise or defence of legal claims.

Moderation, safety & enforcement

We may use automated systems, technical signals, user reports and human review to detect, rank, label, restrict, blur, reduce distribution of, demonetize, hide or remove content and to protect users and platform integrity.

Depending on severity, context and applicable law, we may issue warnings; restrict content or features; limit recommendations, monetization or messaging; suspend accounts; or permanently remove accounts.

Where applicable law requires it, we will provide information about moderation decisions and access to an appropriate complaint or appeal mechanism. See our Safety & Transparency page and Community Guidelines for more information.

Changes to the Platform or Terms

Peekamoji may update, change, test, suspend or discontinue features over time, including where necessary for legal, safety, security, technical, commercial or product reasons.

We may revise these Terms when the Platform, applicable law or our business operations change. Where required, material changes will be communicated through the Platform, website, email or another appropriate channel. The Last Updated date identifies the latest published version.

We will not use a later version of these Terms to retroactively remove non-waivable rights or unlawfully alter a completed transaction.

Service availability, disclaimers & liability

The Platform may occasionally be unavailable because of maintenance, outages, third-party failures, security incidents, network conditions or other events. We do not guarantee uninterrupted availability, error-free operation, specific audience reach, follower growth, ranking, recommendations, VibeScore results, Creator Score results, revenue or that every feature will remain available.

User-generated content, opinions, listings and external links are provided by users or third parties. Peekamoji does not endorse or guarantee their accuracy merely because they appear on the Platform.

To the maximum extent permitted by applicable law, Peekamoji is not responsible for losses caused solely by matters outside our reasonable control or for losses that were not reasonably foreseeable from our breach. Nothing in these Terms excludes or limits liability, consumer rights or remedies where applicable law does not permit that exclusion or limitation.

Leaving Peekamoji

You may stop using Peekamoji at any time. You can delete your account through the app where available or follow our Delete Account instructions.

Account deletion may affect access to Credits, Marketplace activity, creator earnings or pending payouts. The treatment of those items is governed by the relevant feature-specific terms and mandatory law.

Suspension & termination

We may restrict, suspend or terminate access where we reasonably believe these Terms, our policies or applicable law have been violated, where required by a competent authority, or where action is reasonably necessary to protect users, payments, security or platform integrity.

Where appropriate and legally required, we will consider the nature, seriousness, frequency and context of the conduct and provide reasons or an opportunity to challenge the decision.

Valid Credits, creator earnings, refunds, payment records or other financial matters following restriction or termination are handled under the applicable feature-specific terms and mandatory law.

Governing law & disputes

These Terms are governed by Danish law, subject to mandatory consumer and other protections that apply in your country of residence.

Nothing in these Terms limits any right you may have to bring a dispute before a competent court, consumer authority or other dispute-resolution body where applicable law gives you that right.

Other provisions

If any provision is found invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law. Our failure to enforce a provision immediately does not waive our right to enforce it later.

You may not transfer contractual rights or obligations under these Terms where the transfer would undermine account security, verification or platform integrity, except where applicable law permits otherwise. Peekamoji may transfer these Terms as part of a merger, restructuring, financing, sale of business or similar transaction, provided your mandatory rights are not reduced.

These Terms and the policies and feature-specific terms incorporated by reference form the agreement governing your use of the relevant parts of Peekamoji. They do not create rights for third parties except where applicable law expressly provides otherwise.
