Only upload music that you own or are fully authorised to use. By accepting these Terms, you confirm that you hold the necessary rights and accept responsibility for infringement claims, subject to applicable law.
Who these Terms apply to
These Music Terms apply when you submit, upload, publish, distribute or monetize music, sound recordings, beats, samples or content containing music through creator features on Peekamoji (the “Music Content”). They supplement our Terms of Use and Community Guidelines. If you do not accept these Terms, do not upload Music Content through those features.
Your rights and warranties
By uploading Music Content, you represent and warrant that you own or have obtained all necessary, valid rights, permissions, licences and consents to upload it and to authorize all uses described in these Terms, including use by other Peekamoji users in their posts, Peeks and other content, and sharing through supported features. This includes all applicable rights in the musical composition, lyrics, master recording, performances, samples and artwork, including any rights needed to permit adaptations, synchronization with video, public performance, making available and sublicensing.
Your Music Content must not infringe any copyright, neighbouring right, trademark, privacy, publicity or other third-party right. Crediting an artist, buying a song, or finding audio online does not by itself give you permission to upload or monetize it. You must not upload Music Content if you are unsure that you have the necessary rights.
Licence to Peekamoji
You retain ownership of rights you hold in your Music Content. You grant Peekamoji a worldwide, non-exclusive, royalty-free, fully paid-up, transferable and sublicensable licence to host, store, reproduce, adapt, synchronize, transmit, publicly perform, display, distribute, make available and promote that Music Content as part of Peekamoji and its related sharing features, without any obligation to pay you royalties, licence fees or other compensation for those permitted uses, except as separately agreed in writing.
You expressly authorize Peekamoji to make your Music Content available for other users to listen to and, where supported by the Platform, select, reuse, incorporate into, synchronize with, publish and share in their own posts, Peeks, videos, Stories and other content. You authorize Peekamoji to grant those users the permissions necessary for these uses on the Platform, without payment to you. You also permit sharing of content containing your Music Content via Peekamoji's supported sharing tools, including links, embeds and exports to external services, to the extent covered by rights you control and applicable law. This does not grant a blanket licence for independent use of your music outside those features or override the terms of third-party platforms.
This licence continues while your Music Content is available on Peekamoji and, following removal, for reasonable periods required for backups, legal compliance and content already lawfully shared or incorporated into other users' content, to the extent permitted by applicable law. You confirm that you have authority to grant these rights and that the permitted uses do not require additional permissions or payments from Peekamoji or its users, except where expressly agreed in writing or required by non-waivable law. This licence cannot grant rights you do not own or control.
Responsibility and indemnification
You are responsible for your Music Content and for resolving claims with the relevant rights holders. To the maximum extent permitted by applicable law, you agree to defend, indemnify and hold harmless Peekamoji ApS and its directors, employees and service providers against third-party claims, damages, liabilities, reasonable legal fees and costs arising from your breach of these Music Terms, including an allegation that your Music Content infringes third-party rights.
Peekamoji is not a party to a rights dispute solely because the disputed content was uploaded to the Platform. However, nothing in these Terms excludes any responsibility or legal obligations that Peekamoji cannot lawfully exclude, nor does it prevent a rights holder from pursuing a claim against Peekamoji where the law permits.
Complaints, removal and cooperation
Peekamoji may restrict, disable or remove Music Content, suspend creator privileges, or withhold relevant payouts where reasonably necessary to investigate infringement concerns, comply with law or enforce our policies. We may request evidence of licences or permissions and share relevant information with rights holders or authorities where legally permitted.
You agree to cooperate in good faith with rights investigations, promptly provide reasonable documentation on request, and resolve legitimate third-party rights claims. Repeated or serious infringements may lead to account restrictions or termination. Report copyright concerns to support@peekamoji.com.
Creator earnings and additional terms
Acceptance of these Music Terms does not guarantee creator approval, distribution, monetization or payment. Creator earnings and payouts are governed separately by our Creator Earnings & Payout Terms. Music supplied by Peekamoji or a third-party library may be subject to additional licence restrictions presented with that feature.
Acceptance and contact
Before using applicable creator music-upload features, you must actively confirm that you have read and accepted these Music Terms and that you own or have secured all required rights to the Music Content you upload. Peekamoji may retain a record of your acceptance, including the applicable version and acceptance timestamp, in accordance with our Privacy Policy.
